General Terms and Conditions

Rosie Lea Tea is the trading name of Rosie Lea Ltd, company registered in England and Wales (Company number: 8068973).

These Terms & Conditions do not affect your statutory rights as a consumer under British law, and apply to goods ordered via the internet or by phone. We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted at the time you placed your order.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction and using this material without written permission from Rosie Lea Ltd is prohibited.

Payment

Payment can be made by Visa, Master Card, American Express, Solo, Maestro, Delta, Switch and Visa Electron and Paypal. Card payments will be processed at the time of ordering, once we have checked your card details and stock availability To ensure your credit card security and to keep your personal information safe we use Secure Sockets Layer (SSL) technology. All of your data is encrypted prior to being sent over the Internet to our system. Alternatively you can choose to pay by cheque or bank transfer, details of which are highlighted on our website. Customers are subject to validation checks and authorisation by their bank. If the bank issuer of your payment card or cheque refuses to authorise payment, we will not be liable for any delay or non-delivery.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

Orders

Goods and postage must be fully paid for at the time of purchase. All goods offered are subject to availability. We reserve right to cancel order and offer alternative product or full refund in those extremely unlikely cases, when items purchased are not available, we priced them incorrectly or for any other reasonable cause. If your order cannot be completely fulfilled, we will email you offering either a partial refund for those items not available or with the option to cancel your order in its entirety and receive a full refund.
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order and e-mail you again to confirm details. An acceptance of your order will take place on despatch of the good(s) ordered.

Delivery

We will arrange delivery of the goods to the address you specify in your order, it is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered.  Delivery times, please allow 2-3 working days within England, Wales, Northern Ireland and mainland Scotland. It may take longer to deliver items to more remote areas. Delivery times are not guaranteed.

If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we may contact you to advise of any such delays. Please allow up to 21 working days for deliveries outside of the UK.

The recipient is responsible for accepting delivery of items ordered, if the recipient fails to accept delivery, rearrange delivery or arrange a collection this is no fault of our own, and no refund will be offered if items are returned to sender.

IMPORTANT INFORMATION FOR EU CUSTOMERS

Please note, you will be charged import VAT on orders.  Any import taxes, duties and additional fees charged by your local postal service remain your responsibility and we cannot be held liable for these. Failure to pay these fees which results in the order being returned to us will not be eligible for refund if products shipped are of a perishable nature. Please note we will also not refund the cost of shipping of perishable or non-perishable products.


Returns & Refunds

If you are not happy with your purchase, please contact us via email -  info@rosieleatea.co.uk . You are entitled to the right to cancel your order with us within seven days of the receipt of your goods in exchange for a full refund, however this only applies to non perishable items, they must be returned in an unused and undamaged condition, in their original packaging. 

WE ARE UNABLE TO ACCEPT RETURNS OF TEA OR DRINKING CHOCOLATE BARS, UNLESS THEY ARE DAMAGED, DUE TO THE FACT THEY MAY HAVE BEEN CONTAMINATED AFTER SHIPMENT AND ARE CLASSIFIED  AS A PERISHABLE PRODUCT, unless of course we have failed to deliver the product as described.  

On receipt of your order please check your delivery as soon as possible to make sure that all items are present and correct. If any items are missing or damaged please take photographs of the packaging, items within the box along with the packing slip and attach it to your Email. Without these images we cannot resolve the issue and will not able to offer a replacement or compensation.

In case of cancellation and there is no fault with the product, items must be returned at the cost of the customer. If the item is deemed damaged, the delivery charge will be refunded by Rosie Lea Tea.

We cannot accept liability for goods lost in the post.

Product Description

Each product purchased is sold subject to its product description and we take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date and accurate as possible, the information may contain inaccuracies and typographical errors.

Whilst we make every effort to produce our teas in a sterile environment, there is the possibility that our products may contain traces of gluten, cereals, almonds, hazelnuts, milk, soya, mustard and sulphur dioxide. 

Anyone with a pre-existing medical condition or pregnant and nursing ladies should take advice from their medical practitioner before consuming any of our teas and infusions.

Liability

We will use all reasonable efforts to ensure the accuracy of any information we place on the Website, but we make no warranties, whether express or implied in relation to its accuracy.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the contents of this site and we accept no liability for damages arising out of or in connection with the use of this site.

Wholesale and Trade Terms

Rosie Lea Ltd operate a "all monies retention of title" clause. This states that Rosie Lea Ltd will continue to own goods supplied to a wholesale or trade customer until such time as we receive full payment for all goods supplied. Rosie Lea Ltd can enter the customer’s premises to recover goods once payment is overdue and at least 3 reasonable attempts have been made by us to receive payment; These methods may include the following: Telephone call; email communication, or written letter delivered by Royal Mail. Once invoked, the debtor has a duty of care to safeguard such goods until collected.

Law, jurisdiction and language

This web-site, any content contained therein and any contract brought into being as a result of usage of this web-site are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
